1. Eligibility: Poki’s 31 Day Giveaway (“Sweepstakes”) is open to citizens who reside in of one of the following geographic areas: Canada, France, United Kingdom (“U.K.”) (including England, Scotland, Wales and excluding Northern Ireland), and the United States (“U.S.”) including the District of Columbia (“D.C.”) (excluding Guam, Puerto Rico, and all other U.S. territories and possessions) (collectively “Geographic Area(s)”). Individuals who do not reside in one of these Geographic Areas are prohibited from entering the Sweepstakes. Entrants must be eighteen (18) years of age or have reached the age of majority (i.e. legally recognized as an adult) in the jurisdiction where he/she resides. Entrants must also have a valid Social Security number, a valid U.S. Individual Taxpayer Identification Number, Social Insurance Number and/or a valid taxpayer reference number issued from his/her country of residence. Employees of Pokimane, LLC (“Sponsor”), Newman & Lickstein, LLP, Enteractive Solutions Group, Inc. (“Sweepstakes Administrator”), advertising or promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, and any agents acting for the above entities, and their respective parent companies, officers, directors, subsidiaries, affiliates, service providers, prize suppliers, assigns, or any other person or entity associated with Sweepstakes (collectively “Sweepstakes Entities”) are not eligible to enter the Sweepstakes. Immediate family members (i.e. a spouse, domestic partner, child, sibling, or parent) and/or any person, whether related or not, living in the same household of an individual affiliated with a Sweepstakes Entity are also ineligible to enter the Sweepstakes.

By participating in the Sweepstakes, each participant acknowledges and agrees that he/she has carefully read these Official Rules. Each participant understands that he/she is bound by each and every term of these Official Rules. Participation in this Sweepstakes is void where prohibited or otherwise restricted by law. Each participant is responsible for complying with all applicable local, state, provincial, territorial, and federal laws and regulations, in addition to determining whether he/she is permitted to participate in the Sweepstakes. 

2. Sweepstakes Period: For all purposes of this Sweepstakes, the Sponsor’s computer is the official clock and all times refer to Pacific Time (“PT”). This Sweepstakes consists of thirty-one (31) non-connected, individual daily sweepstakes (each a “Daily Sweepstakes”) and one (1) overall sweepstakes (“Overall Sweepstakes”) beginning at 9:00 a.m. PT on August 1, 2025 and ending at 11:59 p.m. PT on August 31, 2025 (“Sweepstakes Period”). 

3. How to Enter: There are two (2) ways to enter the Sweepstakes: Instagram and TikTok (each a “Platform” and collectively “Platform(s)”). To enter the Sweepstakes, entrants must access the applicable Platform; locate any of the Sweepstakes-specific daily video posts (each a “Daily Post” and collectively “Daily Posts”); and (ii) provide a comment relating to the applicable Daily Post (“Comment”) during the Sweepstakes Period as more fully described below. Each Daily Post will be published on the Platforms on or about 9:00 a.m. PT for each Daily Sweepstakes.

     a. Instagram: Entrants who meet the eligibility criteria set forth in section 1 above must first either already be following or begin following Pokimane on Instagram. To follow Pokimane on Instagram at @pokimanelol, entrants must go to https://www.instagram.com/pokimanelol/ (“Instagram Site”) and click the “Follow” button. If an entrant does not already have an Instagram account (“Instagram Account”), he/she can create one for free by going to either the App Store or Google Play and downloading the Instagram App to his/her mobile device. 

Entrants must have an Instagram Account in good standing, must be “following” the Instagram Site, and must Comment on the applicable Daily Post to receive an entry (“Instagram Entry”) into the applicable Daily Sweepstakes and the Overall Daily Sweepstakes. Entrants understand that they are providing their information to the Sponsor and not to Instagram.  

     b. TikTok: Entrants who meet the eligibility criteria set forth in section 1 above must first either already be following or begin following Pokimane on TikTok. To follow Pokimane on TikTok, entrants must go to https://www.tiktok.com/@poki (“TikTok Site”) and click the “Follow” button. If an entrant does not have a TikTok account (“TikTok Account”), he/she can create one for free by going to either the App Store or Google Play and downloading the TikTok App to his/her mobile device.

Entrants must have a TikTok Account in good standing, must be “following” the TikTok Site, and must Comment on the applicable Daily Post in order in order to receive an entry (“TikTok Entry”) into the applicable Daily Sweepstakes and the Overall Sweepstakes. Entrants understand that they are providing their information to the Sponsor and not to TikTok. 

Entrants may submit an Instagram Entry and TikTok Entry (each an “Entry” and collectively “Entry(ies)”) for each Daily Post during the Sweepstakes Period. Each successful Entry results in an entry into the Overall Sweepstakes.

Any attempt by an entrant to obtain more than the stated number of Entries by using multiple/different email addresses, accounts, identities, registrations, logins, AI generative technology or any other methods other than as described herein, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void that entrant’s Entries. If entrants use a web-enabled mobile device to participate, data rates may apply (entrants should contact their service provider for data rates/plans). Entrants should use care and not drive or operate machinery while entering the Sweepstakes.

Entries may not contain, as determined by Sponsor in Sponsor’s sole discretion, any content that: (i) is profane, pornographic, obscene, offensive, inappropriate, explicit, suggestive, violent, indecent, hateful, tortious, derogatory, defamatory, slanderous or libelous; (ii) promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; (iii) violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity or any other intellectual property rights; (iv) includes any URLs; (v) communicates messages inconsistent with the reputation, image and/or goodwill of Sponsor (or any other person or party); (vi) is unlawful or promotes illegal drugs or firearms (or the use of any of the foregoing); and (vii) encourages activities that may appear unsafe, dangerous, threatening, or promotes any particular political agenda or message. Sponsor, in its sole discretion, may disqualify and/or remove any Entry at any time for any reason.

Minors/Age of Eligibility: Minors may enter only if they i) reside in a jurisdiction that permits it, except in Great Britain where minors are not eligible, ii) are eighteen (18) years of age or have reached the age of majority where they reside, and iii) have obtained parental/legal guardian consent prior to entering or submitting any personally identifiable information. For purposes of this Sweepstakes, a minor is: 

     - A resident living in Alabama or Nebraska in the U.S. or a resident of the provinces or territories of British Columbia, Newfoundland and Labrador, New Brunswick, Northwest Territories, Nova Scotia, Nunavut or the Yukon in Canada who is under nineteen (19) years of age

     - A resident of Mississippi in the U.S. who is under twenty-one (21) years of age

     - A resident of Scotland who is under sixteen (16) years of age 

     - A resident under the age of eighteen (18) in the remaining forty-seven (47) states of the U.S., the      provinces of Alberta, Manitoba, Ontario, Prince Edward Island or Saskatchewan in Canada, France, or in the rest of Great Britain.

The Instagram Account and/or TikTok Account (collectively “Account(s)”) used to enter the Sweepstakes must belong to the person that completes the act of physically entering the Sweepstakes. Entries must be received by 11:59 p.m. PT on August 31, 2025. 

4. Prizes/Odds of Winning: The prize(s) that will be awarded for each Daily Sweepstakes will be announced on each Daily Post. The approximate retail value (“ARV”) of each prize is in U.S. dollars (“USD”).Sixty-eight (68) daily mystery prizes will be awarded (“Daily Mystery Prize”) and one (1) overall prize (“Overall Prize”) will be awarded. The Daily Mystery Prizes may include one of the following categories of prizes: merchandise, gift card/voucher/certificate, appliances/cookware, services, personal care, fashion accessories, experiences, equipment, transportation, or electronics as announced and/or revealed on that particular day’s Daily Post. The Overall Prize consists of a one (1) year gym membership (exact gym determined in Sponsor’s sole discretion based on the winner’s residence) with an ARV of $1,500 USD. Daily Mystery Prizes are subject to availability and selected in Sponsor’s sole and absolute discretion. The prizing tiers, the number of prizes in each tier, and the applicable ARV is as follows: 

     Twenty-seven (27) Daily Mystery Prizes will be awarded with an ARV of up to $200 USD each. 

     Nine (9) Daily Mystery Prizes will be awarded with an ARV of up to $500 USD each. 

     Five (5) Daily Mystery Prizes will be awarded with an ARV of up to $1,000 USD each. 

     Ten (10) Daily Mystery Prizes will be awarded with an ARV of up to $1,500 USD each.

     Two (2) Daily Mystery Prizes will be awarded with an ARV of up to $2,200 USD each.

     Six (6) Daily Mystery Prizes will be awarded with an ARV of up to $3,000 USD each.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $3,700 USD.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $4,000 USD.

     Two (2) Daily Mystery Prizes will be awarded with an ARV of up to $5,000 USD each.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $8,000 USD.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $10,000 USD.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $15,000 USD.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $15,050 USD.

     One (1) Daily Mystery Prize will be awarded with an ARV of up to $50,000 USD.

The total ARV of all prizes is up to $169,550 USD. The ARV for winners outside the U.S. is the equivalent amount based on the exchange rate at the time the prize is awarded minus any applicable withholding taxes. If a prize is redeemed at a location outside of the U.S. where the local currency is other than U.S.D., the current exchange rate for that country will prevail.

Odds of winning a Daily Mystery Prize depend on the total number of eligible Entries received for each Daily Post during the Sweepstakes Period and odds of winning the Overall Prize depend on the total number of eligible Entries received during the entire Sweepstakes Period. Limit one (1) Daily Mystery Prize per person/family/household for the entire Sweepstakes Period.

All expenses associated with the receipt or use of a prize not specifically mentioned as being included (e.g., any requested upgrades or applicable duties, customs fees, and tariffs, etc.) are excluded and are the sole responsibility of each winner. Sponsor reserves the right, in its sole discretion, to replace any merchandise with a newer model or version of same; but, in such event, Sponsor will continue to use the value of the “old” (i.e., replaced) item for purposes of calculating the ARV. If a winner elects not to accept a prize or prize component of any kind in its entirety, no additional compensation will be awarded. Due to technical, geographical, and/or logistical challenges/issues, some prizes may only be able to be awarded to a U.S. resident. If a winner is selected from outside the U.S. for one of these prizes, a prize substitution will be awarded which may be a cash award USD for a predetermined portion of the ARV (or the full ARV value) as determined in Sponsor’s sole discretion.

PRIZES ARE AWARDED “AS IS” WITH NO GUARANTEE. ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED BY THE SWEEPSTAKES ENTITIES. No prizes will be awarded to a group or organization. All expenses associated with the receipt or use of the prize not specifically mentioned as being included are excluded and is the sole responsibility of the winner. No cash equivalent for non-cash prize(s) will be available unless determined otherwise in Sponsor’s sole discretion. The prize(s) is not transferable. However, the Sponsor may, in its sole discretion, choose to substitute the prize (or prize component) with one of comparable or greater value due to unavailability or for any other reason. Gift card/certificate/voucher cannot be exchanged/redeemed for cash or combined with any other offer, is subject to stated terms and conditions and must be used by the expiration date stated (if any) or the balance thereof will be forfeited. As applicable, prizes will only be mailed/shipped/delivered electronically to persons residing in the Geographic Areas. Any depictions of the prizes in the promotional materials or otherwise are for illustrative purposes only. Final eligibility for the award of any prize is subject to verification, as set forth in these Official Rules. The Sweepstakes Administrator is not the supplier or guarantor of any prize. 

5. Random Drawing(s):Potential Daily Mystery Prize winners will be randomly selected by the Sponsor in a series of drawings from among all eligible Entries received from each applicable Daily Post on or about September 10, 2025 (each a “Daily Drawing” and collectively “Daily Drawing(s)”). Non-winning eligible Entries will not be retained and entered into subsequent Daily Drawings. The Overall Prize winner will be randomly selected on or about September 10, 2025 from among all eligible Entries received during the Sweepstakes Period by the Sweepstakes Administrator, an independent compliance organization (“Overall Prize Drawing”).

6. Notification: The potential winners will be notified at the applicable Platform associated with their Entry via a direct message on Instagram and TikTok from Sponsor within two (2) weeks after the drawings have been conducted. The notification will include a link to a secure eligibility form which must be completed by each potential winner within seventy-two (72) hours from the date the direct message was sent (“Eligibility Form”). The information required on the Eligibility Form includes: first and last name, mailing address including country, email address, and month/year of birth. Failure to complete the Eligibility Form within seventy-two (72) hours of it being sent will result in disqualification and the prize will be forfeited. If a Canadian resident is selected as a potential winner, he/she must correctly answer a time-based mathematical skill testing question in order to be eligible for a prize. The Sponsor is not responsible if an entrant’s privacy settings on any Platform are set to “private” or otherwise restrict being contacted/notified or prevents the verification of an Entry. If a potential winner(s) does not complete the Eligibility Form within seventy-two (72) hours; is found to be ineligible; if he/she does not comply with these Official Rules; if he/she is a Canadian resident and cannot correctly answer the time based mathematical skill testing question; or if any electronic communication is returned as undeliverable, such potential winner will be disqualified and an alternate potential winner may be selected in Sponsor’s sole discretion. If a potential winner is deemed a minor in his/her jurisdiction, his/her parent or legal/guardian must complete the notification process on his/her behalf. 

7. Prize Claim Documents: Depending upon the prize, potential winner(s) may be required to electronically sign and return an unmodified Affidavit of Eligibility, a Liability Release (where legal), and a Publicity Release (collectively “Affidavit/Release”); an IRS Form W-9 for U.S. winners if the prize value exceeds $600 or an IRS Form W-8 for non U.S. winners; provide a copy of his/her legible government issued photo identification; and provide any other documentation that Sponsor requires (e.g. background check if an experiential prize is awarded in Sponsor’s sole discretion) (collectively “Prize Claim Documents”) within five (5) days of receipt by potential winner(s). The potential winner then and only then becomes the “winner.” If a potential winner does not provide the applicable Prize Claim Documents required herein, as determined in Sponsor’s sole discretion, said person(s) may be disqualified, the prize will be forfeited, and Sponsor will have no further obligation to such potential winner. Electronic documents have the same force and effect as originals. By completing the Prize Claim Documents, each winner attests to the provisions stated therein including the accuracy of the information contained therein and compliance with these Official Rules. If a potential winner cannot be reached, is found to be ineligible, does not complete the applicable Prize Claim Documents in the time frame listed above, and/or if he/she does not comply with these Official Rules, said potential winner will be disqualified. If a potential winner(s) is a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal guardian will be required to sign the Prize Claim Documents on his/her behalf and the prize will be awarded in the name of said parent/legal guardian.

8. Tax Obligations: All federal, state, and/or other applicable taxes (including but not limited to income taxes for a U.S. winner) arising from participation in the Sweepstakes or the award of a prize may be required by applicable tax authorities in the jurisdiction in which a winner resides and is the sole responsibility of each winner. Non-U.S. prize winners may be subject to 30% withholding taxes which must be collected prior to receiving any prizes. U.S. winners will be issued an IRS Form 1099-MISC or equivalent tax reporting documents as for prizes valued over $600, and non-U.S. winners will be issued an IRS FORM 1042 or equivalent tax reporting documents as required by United States law, from the Sponsor for the total ARV of the prize won (as stated herein) in the calendar year won.  

9. Personal Data/Privacy Policy: Entrants understand and agree that personal data/information they provide will be processed in the U.S. (i.e. outside the EEA and/or not in the country or jurisdiction of any other eligible country). Each entrant’s personal data will be used for purposes of administering the Sweepstakes including not limited to any required applicable record keeping, tax forms, state registrations, and/or any prize fulfillment obligations. The Sweepstakes Entities does not and will not sell the personally identifiable information of any entrant or winner. Furthermore, the Sweepstakes Entities will not share or disclose any personally identifiable information to any third-party company or business unrelated to the Sweepstakes. Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of their parent/legal guardian. To the maximum extent permitted by law, any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor’s Privacy Policy located at https://pokimane.com/policies/privacy-policy. To the maximum extent permitted by law, except where prohibited by law and Sponsor’s Privacy Policy: (1) entrant’s acceptance of prize constitutes permission for the Sweepstakes Entities to use an entrant’s first name, last initial, state/province/region and country for advertising/publicity purposes worldwide and in all forms of media (including posting on the Instagram Site and TikTok Site) in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the prizes awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrants or any third parties.  

10. General Conditions: This Sweepstakes is governed by these Official Rules and all applicable federal, state, territorial, provincial, and local laws. By entering the Sweepstakes, and to the maximum extent permitted by law, entrants agree and acknowledge to be bound by these Official Rules, as well as the decisions of the Sponsor and the Sweepstakes Administrator, which are final and binding in all respects; to waive any rights to claim ambiguity with the Official Rules; and to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes or the use of any submitted Entry; and to release all rights to bring any claim, action, or proceeding against the Sweepstakes Entities. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of the Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person. Any person attempting to defraud or tamper with the Sweepstakes may be prosecuted and is not eligible for a prize. If, for any reason, the Sweepstakes is not capable of running as originally planned, the Sponsor, in its sole and absolute discretion, reserves the right to cancel, suspend, and/or modify the Sweepstakes or any portion thereof and to conduct the applicable drawing(s) and award the prize(s) from all salvageable eligible Entries received prior to and/or after (as appropriate) the action taken by the Sponsor, or award the prize(s) in a manner that is fair and equitable as determined in Sponsor’s discretion. In case of a dispute over the identity of an entrant who submitted a winning Entry, the authorized account holder of the Account on the Platform affiliated with that Entry will be deemed the entrant. Said person must comply with these Official Rules, be the person who completed the act of entering, and, in the Sponsor’s sole and absolute discretion, may be required to provide proof of ownership of the Account on the applicable Platform.

11. Disclaimers: This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram or TikTok and Instagram and TikTok are completely released of all liability by each entrant in this Sweepstakes. The Sweepstakes Entities are not responsible or liable for Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), in excess of the stated limit, or for Entries that are illegible, late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, misplaced, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, or otherwise not in compliance with these Official Rules. Any such Entries will be disqualified. By entering the Sweepstakes, the entrants agree and acknowledge that the Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury, or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of usernames, social media handles; acceptance/possession, use/misuse, and/or defects of prize (or prize element) awarded herein; typographical errors in the Sweepstakes promotional material; interruption/cancellation of a Daily Post, promos, or elements of Sweepstakes; fraudulent (including unauthorized) gift cards/ certificates/vouchers made with lost, stolen, misplaced, misappropriated or incomplete (including inaccurate) database information and/or canceled gift cards/certificates/vouchers; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; any interruption or inability to access any Platform or Account (or Sponsor’s/Sweepstakes Administrator’s inability to access a Platform or Account), or any website or online service via the internet due to hardware or software compatibility problems or due to a ban by a government due to security concerns ; wireless network dead zones or obstructions; any damage to an entrant’s (or any third person’s) computer/mobile device and/or its contents related to or resulting from any part of this Sweepstakes or from entering or downloading materials/software in connection with the Sweepstakes; and/or any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions; any technical or mechanical error when posting/uploading Daily Posts even if caused by the negligence of one of the Sweepstakes Entities. Entrants hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including any applicable express warranties provided exclusively by a prize supplier that may be sent along with a prize. To the maximum extent permitted by law, the Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused by or have contributed to (1) any wrongful, negligent or unauthorized act or omission on the part of a prize supplier or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (3) any other cause, condition, or event whatsoever beyond the control of the Sponsor or its parents, subsidiaries, and affiliated companies. The failure of the Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, demonstrations, riot, earthquake, terrorism, act of public enemies, strikes, epidemics, pandemics, actions of governmental authorities outside of the control of the Sponsor (excepting compliance with applicable codes and regulations), or other force majeure event will not be considered a breach of these Official Rules. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.  

12. Governing Law, Jurisdiction, Arbitration:  All entrants acknowledge and understand that they are entering into a Sweepstakes being run and administered in the U.S. and acknowledge that the Sweepstakes is subject to the laws and exclusive jurisdiction of the U.S. State of California to the maximum extent permitted by law. Any controversy or claim arising out of or relating to (i) the Sweepstakes, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the state of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. To the maximum extent permitted by law, any controversy or claim arising out of or relating to these Official Rules, its enforcement, arbitrability or interpretation shall be submitted to final and binding arbitration, to be held in Los Angeles County, California, before a single arbitrator, in accordance with California Code of Civil Procedure §§ 1280 et seq. The arbitrator shall be selected by mutual agreement of Sponsor(s) and the entrant or entrants bringing forth the controversy or claim, which to the extent permissible must be brought individually and not as part of a class/group (collectively, the “Parties”) or, if the Parties cannot agree, then by striking from a list of arbitrators supplied by the American Arbitration Association or JAMS/Endispute. The arbitration shall be a confidential proceeding, closed to the general public. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator’s award is based. The Parties will share equally in payment of the arbitrator’s fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert, and attorneys’ fees and other expenses to the same extent as if the matter were being heard in court). To the maximum extent permitted by law, entrant(s) agrees that his/her claim will be resolved individually, exclusively by arbitration (where legal), without resort to any form of class action. To the maximum extent permitted by law, each entrant(s) further agrees that any claim/judgment/award in such arbitration shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Sweepstakes and in no event will entrant(s) be permitted to obtain attorneys' fees, other legal costs and/or be entitled to awards. To the maximum extent permitted by law, entrant(s) hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. Should any term of this section be deemed by a tribunal of competent jurisdiction void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring this section within the requirements of law, be deemed to be severed from the other terms of these Official Rules, and the remainder of these Official Rules shall be given effect as if it had not included the severed term herein. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF. 

In the event of any conflict between any provision of these Official Rules and any statute, law, or regulation in any jurisdictions, the latter will prevail; provided, however, that in such event, the provision(s) of these Official Rules so affected will be curtailed and limited only to the minimum extent necessary to permit compliance with the requirement(s) of such statute, law, regulation or provision, and all other terms of these Official Rules will continue in full force and effect.

For United Kingdom participants, any dispute arising in relation to them, shall be governed by English law, and subject to the exclusive jurisdiction of the courts of England and Wales. Notwithstanding any other provision of these Official Rules, if and only to the extent English law applies, nothing in these Official Rules shall limit or exclude any type of liability which may not be lawfully excluded or limited, including liability arising for death or personal injury caused by negligence, or for fraud.

For French participants, any dispute arising in relation to them, shall be governed by French law, and subject to the exclusive jurisdiction of the courts of France.

For Quebec participants, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Rules/Winners List: If you live outside the U.S., to receive the winners list or the rules, send an email to business@pokimane.com with the name of the Sweepstakes in the subject line and specify if you want the rules or the winner list in the body of the email. If you live inside the U.S., to receive the name of the winners or a copy of these Official Rules, send a self-addressed stamped envelope to: Poki’s 31 Day Giveaway “Winners List” or “Rules” (specify which), 3006 S Vermont Ave, Los Angeles, CA 90007 P.O. Box 465 U.S. All requests must be received by October 31, 2025. The winners may also be posted online in Sponsor’s discretion. The Winners List will only contain the following information: first name, last initial, state/province, country, prize won, and prize value.
